Government introduces legislation to reaffirm Police tools to prevent, disrupt, and address crime

The Government has introduced a Bill to amend the Policing Act 2008, reaffirming Police’s ability to record images and sounds in public places, and some private places, as well as expanding temporary area closure powers.

Following the decision of the Supreme Court in the Tamiefuna case, Police’s ability to record images and sounds in public places, and collect personal information for lawful purposes, including intelligence was constrained.

“This created uncertainty and made the collection of evidence, and therefore the prosecution of criminals, much harder” says Police Minister Mark Mitchell.

“The government has introduced a bill to reaffirm the prior common law position, making it clear that Police can collect and use images in public places, and some private places, for lawful policing purposes. This includes intelligence gathering, crime prevention, and other policing functions.

“These changes will enable that and strengthen Police’s ability to detect and prevent crime, and hold offenders accountable for their offending. Ultimately it will help Police keep Kiwis safe.”  

The Government is also expanding Police’s existing temporary road closure powers to cover a broader range of areas, such as parks, reserves, beaches, and carparks.

The changes will give Police new tools to manage non-compliance with temporary closures, including the ability to direct people to leave a closed area, stop vehicles, obtain identifying particulars for the purpose of issuing infringements, and arrest without warrant those who fail to comply.

The new powers will also leverage existing powers that are being progressed through the Antisocial Road Use Legislation Amendment Bill, led by Minister Chris Bishop.

“These new powers will provide clarity and consistency for frontline Police, ensuring they have the necessary tools to support the Governments Law and Order agenda,” Mr Mitchell says. “They will be useful tools to help Police respond to incidents like street racing and dirt bike riding in public parks.”

Greenpeace – Thousands call on Christopher Luxon to condemn the illegal attacks on Iran by Trump and Israel

Thousands of people have signed a petition demanding Christopher Luxon stand up and condemn the illegal attacks on Iran by the United States and Israel. Greenpeace delivered the petition to opposition leader Chris Hipkins in Wellington today.
Standing on the steps of parliament, Greenpeace Aotearoa Executive Director Dr Russel Norman said, “This war is plainly illegal – it is not an act of self-defence nor is it sanctioned by the UN Security Council.
“While we have come to expect that the US Government approach to international law is more honoured in the breach than the observance, nonetheless international law is critical for the security of everyone on the planet but especially for a small nation like New Zealand.
“We expect Christopher Luxon to advocate in favour of international law and hence condemn this reckless illegal war.
“Silence in the face of injustice is complicity, and thousands of New Zealanders agree that Luxon should be standing up to bullies like Trump, who is attempting to destroy any possibility of a rules-based international order.”
Greenpeace delivered the petition to the Parliament Opposition who have been open about their condemnation of Trump’s illegal war.
Greenpeace also made the link from this illegal war to the escalating price of fossil fuels.
“This illegal war has disrupted oil, gas and fertiliser supplies, exposing Luxon’s Trump-like obsession with outdated fossil fuels, leaving New Zealanders paying the price,” continued Dr Norman.
“Luxon has collapsed the EV market by killing the clean car discount, making it cheaper to import gas guzzling cars. He’s ended public transport subsidies for young people, blocked funding for cycleways, but wants to spend billions of dollars to build new roads.
“Now Luxon wants to expose us even further to the volatile global fossil fuel market by charging New Zealanders a gas tax to build a LNG import terminal.
“The Luxon government should be investing in renewable energy and the electrification of transport to insulate New Zealanders from energy supply shocks and rising energy prices, as well as cutting climate pollution,” says Dr Norman.

Universities – Traffic silently killing Aucklanders – UoA

Pollution from cars in Auckland is killing around 700 people a year and hospitalising 4,000 more, with health researchers calling for policy changes.

More than 700 Aucklanders die every year from air pollution from traffic, similar to the number who die from smoking cigarettes, with almost 4,000 more ending up in hospital, according to a new report.

Almost all Aucklanders, 90 percent, are exposed to dangerous levels of air pollution higher than international standards.

Nationally, 2,000 people die per year from traffic pollution.

“Because the particles are so small, they are not easy to see, so we often don’t even think about them being there,” says Dr Jamie Hosking, a public health researcher at Waipapa Taumata Rau, University of Auckland.

“Sometimes, when we’re close to traffic, we can smell the exhaust, and that’s when we really notice it. But even when we can’t smell it, it’s still there, putting our health at great risk.”

Petrol and diesel burn to produce noxious gases, chiefly nitrogen dioxide (NO2), and minute particles of soot, smoke, dust and chemicals (PM2.5).

“Because they’re so small, these particles can get right into our lungs and then cross into the bloodstream. They cause health effects through their impact on the lungs, but also on our cardiovascular system – the heart – and can contribute to strokes,” Hosking says.

A report, Our Air, has just been published on Auckland’s air pollution by Healthy Auckland Together a collective of public health researchers and agencies working in the area. Hosking and fellow public health researcher at the University of Auckland Professor Alistair Woodward will present the report to Auckland Council’s Transport Committee and call for urgent action on Auckland’s air pollution.

Auckland’s air pollution comes partly from household heating but pollution from traffic is by far the biggest cause of illness.

It is estimated traffic pollution causes 6,100 cases and 424 hospitalisations for childhood asthma every year in Auckland.

People in cheaper housing near motorways and busy roads are at extra risk, so there are equity issues.

“It’s often people on lower incomes who end up being more exposed to this dirty air and then having the health impacts as a result,” Hosking says.

What Auckland Council needs to do

The report outlines solutions. The 20 agencies comprising Healthy Auckland Together would like to see Auckland Council:

  • Invest in affordable, clean and frequent public transport services 
  • Introduce equitable congestion charges 
  • Build and maintain attractive footpaths and pedestrian crossings, and protected cycle lanes
  • Improve air quality monitoring 
  • Provide more parks and street trees 

What central government needs to do
Nationally, the government needs to:

  • Raise vehicle emission standards to ensure cleaner vehicles enter the country
  • Update New Zealand’s air quality standards to reflect the latest health evidence
  • Set transport charges – such as fuel excise, road user charges and registration fees – so they properly reflect the health and social costs caused by vehicle emissions.

Air pollution in Auckland results in a significant number of deaths and serious illnesses with unacceptable healthcare and social costs – urgent action is needed.

Waikato Steel Manufacturing Project Fast-tracked

A structural steel manufacturing plant that will help build the future of New Zealand’s infrastructure has been approved through Fast-track.

National Green Steel Limited lodged its application in July 2025 to build a structural steel manufacturing plant in Hampton Downs in Waikato.

“Approval has taken around five months following the commencement of the expert panel,” says Mr Bishop.

“New Zealand has a major infrastructure deficit. We need to deliver infrastructure faster, and we need the supply chains to back that up. A project like Green Steel can do both, building local manufacturing capacity and help provide material for a range of developments.

“The new plant will process about 200,000 tonnes of recycled steel annually. The project will reduce structural steel imports and reduce the amount of scrap steel being exported. Green Steel already has collections yards in Auckland, Wellington, Hamilton, Putāruru and Christchurch. These yards recover metal resources from end-of-life vehicles, sheet metal, and beams.”

The project is expected to create about 200 skilled jobs in the region. New Zealand does not currently re-use steel – most of our scrap metal is exported. This new plant will mean we can recycle and manufacture structural steel right here in New Zealand, using material sourced from across the country,” Mr Jones says.

“The project will use electric arc furnace technology to produce high-quality structural steel with a lower carbon footprint compared to current steel production methods used in New Zealand,” Mr Watts says. 

“This proposal shows the sector are willing to make the investments needed to electrify. It’s a positive sign that industry is ready to move at pace to build the infrastructure we need.”

“This is the 13th project to be approved under the Fast-track process, and the first infrastructure project to feature steel manufacturing,” says Mr Bishop.

False alarm shows mine’s safety culture is built to last

A routine incident at New Zealand’s deepest gold mine has given WorkSafe inspectors rare, real-world proof that years of joint safety training are paying off.

WorkSafe has been embedded with the Snowy River gold mine project, near Reefton, since 2018. But in November 2025 safety lessons were put to the test.

A dump truck operator at the mine spotted what he thought was smoke rising from his vehicle during a during routine work, he acted immediately. He triggered the automatic fire suppression system and activated emergency protocols immediately. Within minutes, all underground workers had retreated to self-contained refuge chambers – airtight shelters capable of protecting workers from smoke and gas for up to 48 hours.

The “smoke” turned out to be harmless steam from the engine’s coolant system. But the response was anything but routine.

“Speed is everything in an underground fire,” says WorkSafe extractives chief inspector Paul Hunt. 

“These chambers are lifesavers – and historically, underground fires are among the most dangerous events in mining.”

WorkSafe’s lead mines inspector John Ewen, who has worked alongside the site’s team, says the response reflected something that can’t be fabricated.

“Trust, respect, consistency and communication is key – even if it means fielding calls at two o’clock in the morning. It comes down to years of rigorous inspections and reviews, so mine operators know they can call me any time if they’re not sure about something.”

On a recent site visit, John Ewen quizzed a new employee about emergency procedures. The worker answered without hesitation. “It shows the company is taking safety seriously. It’s so rewarding to witness.”

He says had the incident been a real fire, he is confident every worker would have made it out safely.

But Paul Hunt is clear: one strong result doesn’t mean the job is done.

“This shows the systems in place are quite good. But there are no guarantees – there could be a serious incident next week. You can never get too confident, otherwise you’re in trouble.”

Snowy River general manager Patrick Enright credited the whole team. “Through training and a programme of emergency exercises with internal and external input, the team have come a long way. It is very comforting to know that if a situation does arise, the team are well placed to handle it.”

Gold production at Snowy River is expected to begin later this year.

Serious crash: Mayoral Drive, central Auckland

Police are in attendance at a serious crash in central Auckland this morning.

At 7am, a crash involving a vehicle and scooter has occurred at the intersection of Mayoral Drive and Cook Street.

The scooter rider is currently in a critical condition, and is being transported to hospital.

Police have put cordons in place and motorists should avoid the area if possible.

Those cordons are in place on Mayoral Drive near the intersections with Greys Avenue and Cook Street, as well as at the intersection with Hobson and Cook Streets.

The Serious Crash Unit is enroute, with a scene examination and crash investigation to commence.

Operationalising the Australia-New Zealand Alliance: Anzac 2035 – Closer Defence Relations Statement

At approximately 4:30am on the 25th of April 1915, the first ANZAC landing at Gallipoli forged a bond unlike any other; changing the Australian and New Zealand relationship forever. Since then, Australians and New Zealanders have served and fought 
side-by-side with selflessness, courage, perseverance, and mateship, to defend our freedom, our values, and uphold a peaceful world. 

This year we celebrate the 75th anniversary of the formal establishment of the Alliance in the 1951 ANZUS Treaty, and reflect on the legacy of 111 years of Anzac history. Our Alliance continues to underpin the defence relationship between New Zealand and Australia. Australia’s Deputy Prime Minister and Minister of Defence Richard Marles and New Zealand’s Minister of Defence Judith Collins KC today reaffirm our formal commitments to each other as allies. We share a long history grounded in democratic values, an enduring commitment to multilateralism and international law, and our collective commitment to a peaceful, stable and prosperous Indo-Pacific region. 

Anzac 2035 Vision

The Australian and New Zealand Defence Forces are operationalising our Alliance with a vision of being able to operate seamlessly as an increasingly integrated, combat capable Anzac force by 2035, while remaining respectful of our status as two sovereign countries. In the face of a sharply deteriorating security environment, we must be ready to meet the security threats we face today and in the future.

Operationalising our Alliance builds on the significant work to date to strengthen integration. Our two militaries are building deep interoperability and interchangeability, including through common procurement and development of platforms and systems, where it makes sense to do so. We will be force multipliers for each other and combine our military forces in defence of our sovereignty, shared interests, and common values, and territory.

Operationalising our Alliance includes lines of effort across force posture activities, combined operations and exercises, preparedness, defence industry integration, resilience, and Pacific security as ways to protect our sovereignty and uphold regional security. 

Line of Effort One – Force Posture Activities

Further enhancing our ability to train and operate from each other’s territory strengthens our ability to respond to the threat of conflict and the prospect of coercion. Force posture cooperation enables us to project force to deter actions contrary to the security of our region and respond to crises. Our cooperation to monitor military activities in our region in 2025 demonstrated our ability to work together in pursuit of shared objectives. Deepening force posture cooperation will bolster our interoperability, our Alliance and collective deterrence. 

By 2035, we will:

  • Enhance force posture cooperation, including rotational activities in, from, and through our respective geographies, where this is in each countries’ national interest; and
  • Scope ways to increase Australia and New Zealand’s participation in each other’s force posture activities and force posture activities of our partners.
  • Establish and use an Australia-New Zealand Force Posture Working Group to develop recommendations to advance force posture cooperation.

Line of Effort Two – Combined Operations and Exercises

Australia and New Zealand’s combined operations and exercises in the Indo-Pacific are an important contribution to deterring potential threats and promoting a stable, resilient region in which international rules are respected. Increasing the complexity of our combined operations and exercises will mean that by 2035, we will be able to increasingly integrate our forces should the need arise. 

By 2035, we will:

  • Operate and exercise as a more integrated Anzac force alongside other allies and partners;
  • Deploy increasingly integrated and interchangeable units to achieve our 2024 Closer Defence Relations Shared Defence Objectives;
  • Further strengthen combined mission planning, combat readiness, and synchronisation mechanisms, including through the presence of embedded staff in each other’s strategic and operational headquarters;
  • Exercise and plan for a range of potential crises and contingencies, including through Exercise TALISMAN SABRE; and
  • Procure and employ common and complementary capabilities on our exercises and operations, including strike capabilities in a variety of domains, autonomous systems, maritime and air platforms and equipment, and land systems, where it makes sense to do so.

Lines of Effort Three, Four and Five – Force Preparedness, Resilience and Defence Industry Integration

Modern conflicts reinforce the need to be able to sustain military operations over time, and to have the resilience and industrial depth to support those operations. This also means building our collective capabilities and self-reliance within our Alliance construct. Cooperation across preparedness, resilience and defence industry is critical for us to generate and sustain the ability to achieve our 2024 Closer Defence Relations Shared Defence Objectives, drive cost-effective solutions, build resilience into our respective supply chains, and develop cutting-edge technologies. 

By 2035, we will:

  • Build understanding of our respective and collective force readiness that underpins our ability to generate military power;
  • Foster Australian and New Zealand sovereign capabilities and industries where possible to leverage our respective cutting-edge technology development;
  • Reduce barriers to defence industry participation in our respective industries and build connections across our defence industry representative bodies;
  • Increase resilience of our sovereign industrial bases and supply chains to increase self-reliance to better support our shared defence needs; 
  • When it makes sense to do so, explore opportunities to co-develop, co-produce, and co-sustain common capabilities further entrenching our ability to act together in support of shared interests;
  • Leverage Australian and New Zealand sovereign capability and sustainment services to increase shared logistics and sustainment (eg C-130J and P-8A), which provide redundancy for our respective defence forces; and
  • Optimise collective training, education, exchanges and attachments to focus on common operating platforms. 

Line of Effort Six – Pacific Security

New Zealand and Australia are Pacific nations. Our security is inextricably linked with the security of the broader Pacific region. Recognising our shared geography and the importance of our defence relationships with our Pacific partners, we will continue to support combined operations and exercises in the Pacific. We will work through the region’s security architecture to continue delivering Pacific-led solutions to regional security challenges and enhance our collective capabilities. 

By 2035, we will:

  • Increase Pacific defence force interoperability across a range of military tasks, with a focus on embedding the Pacific Response Group as a regional asset that enables more effective co-deployments in times of need, such as disaster response situations;
  • Expand our combined operations and activities in the Pacific to address regional security concerns;
  • Increasingly work through the South Pacific Defence Ministers’ Meeting (SPDMM) to meet defence needs of the Pacific in accordance with Pacific aspirations and the Blue Pacific Ocean of Peace; and
  • Increase our support to Pacific-led combined maritime activities to uphold and bolster regional maritime security.

Implementation and Monitoring

This statement on Operationalising the Alliance, our 2024 Joint Statement on Closer Defence Relations, and our defence dialogue architecture provide the policy framework to regularly review, update and adapt our Alliance. Subordinate working groups will take forward practical implementation initiatives against each of the lines of effort above. ANZMIN will remain the primary vehicle for managing our Alliance.

Four in custody following fleeing driver incident

Police have arrested four men after they carried out a home invasion and fled across parts of Auckland.

At around 3.10pm Police received reports of an aggravated burglary at an address on Bleakhouse Road, Howick.

The offenders were reported to be in possession of a machete and left the scene in a Ford Ranger stolen from the address.

A short time later Police sighted the vehicle heading towards the East Tāmaki area.

Eagle monitored the vehicle as it drove dangerously through Ōtara, Manukau and onto the Southern Motorway into the central city.

On multiple occasions it was seen driving on the wrong side of the road at high speeds.

Through the course of the incident, it has been involved in several collisions with vehicles belonging to members of the public.

Police vehicles were rammed on more than one occasion.

Given the risk posed the Armed Offenders Squad was deployed and pursued the vehicle on Queen Street.

AOS has carried out a non-compliant vehicle stop on Karangahape Road, immediately taking all four occupants into custody.

Police deployed a range of tactics including a distraction device, a non-lethal sponge round and a Police dog to effect the arrests.

One person was transported to hospital in a moderate condition after receiving injuries from a dog bite.

It is extremely lucky that the reckless behaviour of these individuals did not result an anyone suffering serious injuries.

Police will be laying charges for the number of offences committed this afternoon.

New facial recognition technology is being worked on that could detect if someone is driving drunk with just a three second video.

Researchers in Australia have been working on the project using artificial intelligence for about two years.

The aim is for it be able to detect whether a person is driving drunk or likely to be a dangerous driver because they are angry or fatigued.

Dr Zulqarnain Gilani from Perth’s Edith Cowan University told First Up the algorithm that’s being developed uses a three to 10 second video of a person to see if they are drunk or fatigued, using their expression.

The technology can also determine a person’s blood alcohol level, Dr Gilani said.

“The algorithm currently can detect five expressions, whether a person is happy, sad, angry or showing disgust, whether they are tired or not tired, or fatigues or not fatigued, and their blood alcohol level as well.”

Through testing, Gilani said videos of people driving a simulator in three different intoxication states with differing blood alcohol levels has been used.

The current technology has a 93 percent accuracy level, he said.

Gilani said it was important that AI used be tested thoroughly on all ethnicities and different conditions.

The current algorithm has been tested on a small cohort of 65 – which was a proof of concept test, he said.

The next steps were to collect more and diverse data if they were to implement this in real life.

Asked how the technology could determine mood, Gilani said it all stemmed around psychology.

“Psychology literature tells us that humans display different, either expressions or psychological states, and their faces show that.

“For example, they say that if somebody is drunk, they blink really fast. And the time for which they close their eyes slows down, so they close it for more time.”

They also suffer hot flushes, he said.

“Whereas if someone is tired, their eyes are droopy. Now the interesting thing is that if somebody is very fatigued and someone is intoxicated, they show almost the same sort of behaviour.”

There were two practical scenarios that the researchers saw for implementing this in real life.

Gilani said the first was to have roadside cameras with the technology which could pick up someone who was driving in an impaired condition and somehow, flag it.

“This is a work in progress. How do we do that and how do we flag it and how do we warn the driver?”

The other was to have the technology inside a person’s car. Gilani said many cars these days have an electric ignition. If a camera facing the driver had the technology and detected a person was impaired, the car wouldn’t start.

Gilani said the project required funds.

“We are actively working with different collaborators, partners and also applying for different fundings so that we can collect more data and make this thing practical.”

One man, two brutal killings two decades apart: How the mental health system ‘failed everybody’

Leslie Parr was spiralling.

It had been 27 years since he’d killed his ex-partner Fiona Maulolo, stabbing her repeatedly with a chisel before beheading her.

Following his first killing he was made a special patient under the Mental Health Act after a jury found him not guilty of murder by reason of insanity.

From about 2012 he was back in the community and in 2021 he had his status change to being a patient under the Mental Health Act.

But by early 2024 his mental health was rapidly declining, he was having troubles with his relationship and he was using cannabis. In May 2024 he was admitted to a mental health facility after an altercation with a relative. About a week later he was released back into the community.

Then, five days later he killed “the most important thing to him” – his mother Heather Condon. Once again, he would be found not guilty of murder by reason of insanity.

The case was shrouded in secrecy until RNZ revealed it last year.

On Monday, the Supreme Court dismissed Parr’s application for leave to appeal a decision declining name suppression, allowing RNZ to reveal the full details of the killing.

RNZ has obtained court documents including statements from those who knew him best that lift the lid on Parr’s life, his mental health battles and his family’s anger with the mental health system.

“How can someone who has previously killed another person be able to remain free when the warning signs are right there for all to see?” his father wrote.

‘Cold and sinister’

Leslie Raymond Parr was born in 1974. He was the youngest of four siblings, and a year after he was born the family moved to Whanganui.

Parr’s father Harold Parr would later tell police the children were “all good kids”.

“My boys and I would do lots of things together like hunting, fishing and I coached their school rugby team.”

Wanting the best for his sons, Harold Parr sent them to St Stephen’s secondary school in Auckland.

After finishing school, Leslie Parr returned home. His parents soon separated and Harold Parr moved to Taupō before going to live in Wellington.

Leslie’s troubles were first expressed in 1995 when he developed insomnia, with a decrease in appetite over several months.

He was admitted to a psychiatric unit under the Mental Health Act in August that year after attempting suicide. On admission he was overheard saying “Satan will kill us all. Here to save you”.

A psychiatrist found he was suffering from a disorder of the mind.

“I can only say, most emphatically, that Mr Parr should remain in a psychiatric hospital as an involuntary patient. He is really very ill and is at risk of suiciding. I fear the type of schizophrenia he has is one that is associated with impulsive and often successful suicide attempts, usually based on concealed delusional thinking.”

Parr was then made the subject of a Compulsory Treatment Order. After responding well to medication he was released.

Harold told police about “episodes” Leslie had while living with him.

“I knew he was suffering from something serious because he was so dark and cold when he had an episode.

“I noticed it mostly in his eyes, they were just cold and sinister looking.”

‘I had to kill her’

Leslie met Fiona Maulolo in 1996 and the pair soon moved into a property in the Hutt Valley.

Soon after meeting Maulolo, Leslie stopped taking his antipsychotic medication regularly and had an “episode” which led to him being admitted to Porirua Hospital.

Parr was described as a man who was “depressed and delusional”, thinking that his father was Satan. He was predicting the end of the world in the year 2000, and said he heard voices telling him to kill himself.

When his medication was reintroduced he began to deny psychotic symptoms.

On the day he was due to be discharged from hospital he seriously assaulted a police officer who was visiting the same ward.

Parr told a psychiatrist he didn’t believe he was to blame “because the constable had looked at him”.

Parr was then made a compulsory inpatient for six months under the Mental Health Act.

However, he was released nine days later, on 28 March 1996. He was not seen again by mental health services until 15 April 1997 after he was found semi-conscious in a carport at Maulolo’s property.

He was transported to Hutt Hospital by ambulance and admitted to the Intensive Care Unit. He later regained consciousness and underwent a psychiatric assessment before he was discharged into his father’s care.

Three days after he was admitted to hospital his father and another person went to collect some clothes for him from Maulolo’s home. On arrival they found Maulolo’s daughters and a relative who had not heard from Maulolo for a week.

They forced their way into the home and found Maulolo’s body in the bath. Police were then called.

Maulolo had been decapitated with her head found in a plastic bag in a clothes dryer. Forensic evidence revealed Parr had driven a chisel multiple times into her heart before decapitating her.

He went on trial for murder in 1998. At trial police said Parr and Maulolo’s relationship was “volatile” with neighbours describing constant verbal arguments and fights between them. There was a suggestion Maulolo was looking to end the relationship.

He told police he killed her because he believed she was Satan.

A jury found Parr not guilty by reason of insanity. A judge ordered he be detained in a special secure unit and not freed without the health minister’s authority.

A coroner later said Parr’s treatment had been seriously deficient.

There had been no ongoing assessment of Parr’s mental health state, or monitoring of his medication needs between when he was discharged and when the murder occurred.

Parr’s hospital file showed that a clinical review of his mental health had been carried out by his responsible clinician, Dr Linda Astor.

She claimed she had examined Parr and “consulted with other health professionals” involved in the treatment and care of him, and that she had taken their views into account when assessing the results of her review of his condition.

She said he was fit to be released from compulsory status, nine days into what was supposed to be six-months as a compulsory patient.

There was, however, no evidence Dr Astor ever saw Parr or consulted with other health professionals involved in his treatment and care.

Astor later fled the country and was unmasked as a bogus psychiatrist.

‘He was very loving and caring’

Parr was transferred to Te Awhina, an inpatient acute mental health service, to be closer to his family in 2000. He was put on a different medication and his mental health “improved a lot,” his father said.

In the coming years he started doing day visits accompanied by a nurse and even got a job.

Once he was released eventually released from Te Awhina he started going by the name Zac.

At first he lived with his mother, before finding his own place. Harold said Leslie looked after his mother and grandfather including doing their lawns.

In 2021 the special patient order was removed.

In 2023 Leslie met a woman Rachel (not her real name) via online dating, by September they were in a relationship.

The woman told RNZ Leslie, who told her his name was Zac, seemed “perfectly fine”.

“He was very loving and caring and treated me incredibly well.”

She would later tell police Leslie was “always helping his family”.

“Especially his mum and as far as I knew he was a good person, a kind person.”

Harold told police that Leslie spent several years working at a local freezing works but left after people found out about Maulolo’s death. He went on the benefit for a few years before getting a job at a milk factory cleaning trucks.

In March 2024, the work “dried up,” his father said and Leslie was laid off and went back on the benefit.

Harold said he visited his son days before his birthday in April to help as he was having a party.

“When I arrived, Leslie was there with a friend, and they were bouncing off the walls. It was obvious him and his friend had used drugs.”

The following day Harold told Leslie to get off the drugs or he would call the police.

The pair did not have much contact after the incident as they were “both annoyed at one another”.

It was not until May that Leslie told Rachel he killed his former girlfriend in 1997.

“I laughed and thought he was joking but he had a dead-pan face and I eventually realised he was not joking, and I screamed and told him to leave.”

After he left, she looked him up online and read about what happened to Maulolo.

“At the time I thought it had been years earlier and he wasn’t well at the time and the case had not been handled well, lots of mistakes involved.

“So, I believed it was a one-off thing due to all the circumstances and not likely to happen again.”

Leslie also sat down with her and said he was on the wrong medication at the time and claimed he begged them not to let him go because he knew he wasn’t well.

The admission

In May 2024, following an altercation with a relative he was admitted to a mental health facility.

Rachel said after the admission she became “very scared and very terrified”.

He was released after about a week on 30 May. Following his release, he became preoccupied with the loss of keys to his ute which he could not find.

Harold told police his son did not sleep for four nights, worried about his ute.

“He was so agitated about his keys and seemed really scared and stressed,” he said.

“I could tell how much it was affecting him and he just wouldn’t let it go.”

Leslie visited his father’s home on 3 June. He did not go inside, and just sat on the back doorstep.

“He started to remind me of how he behaved in Wellington when the other incident happened.

“Leslie had those dark eyes and wasn’t present. The biggest thing I notice when he’s like that is you can’t reason with him. He talks so fast and frantic that you don’t even have time to answer.”

Rachel’s concerns were also growing.

“I started to see a side to him I didn’t like.”

He started becoming delusional and irrational which appeared to coincide with his consumption of marijuana increasing a lot higher than she had noticed before.

“He said some weird things to me about his mum not being a human and that she was a Demi-God.”

When she heard he was going to be released from the mental health facility she worried “maybe he’s gonna come for me”.

“But I didn’t want to come tell the police because I thought I needed to try get out of it quietly, because I thought if I piss him off, you know you can get protection orders, you can get that but it’s just a piece of paper they can still kill you.”

A day after he was released Leslie messaged Rachel and said he did not love her anymore and wanted to break up.

The following morning, about 4.30am, Rachel woke up to tapping on her ranch slider. She got up and he was standing outside. He said he had been drinking with his friend all day and night and he had been sick and then drove to her place. He ended up staying the night.

Two days later she was mowing her front lawn when she saw him sitting in his car on the road watching her. Rachel asked him what he was doing, and he replied: “Oh, I love you and I want to be with you.”

She told him he was stalking her and was being “creepy”. He took off, but she then saw him again about an hour later across the road. She told him to go away, and she would see him later on.

The next night he visited her home after repeatedly asking to come over. The couple were arguing back and forth in her bedroom.

Rachel said she told him she did not think the relationship was working and he needed to leave.

He refused to leave and asked her what she was going to do about it. She threatened to call the police and then he left.

A second killing

The following morning, the day of the second killing, Parr called Rachel to say he needed someone to pick him up as he had driven out of town and his car broke down in Bulls. Rachel said she was reluctant to help him but eventually relented.

However, when she got there he was not there. Rachel then called Heather and said she could not find him.

Heather said she wondered if he was testing her.

“I said to her, ‘Yeah, he’s been acting very, very strange’ and she started to get upset and said, ‘Yes, I’m very worried about him and he’s been saying that he can’t trust anybody, that he can’t trust me, he can’t trust his dad and he only trusts you and that he only feels safe with you’.”

Shortly after Leslie called Rachel and said his phone had gone flat and he got a lift with someone else.

Leslie had also been calling his father earlier in the day. Leslie’s sister called Harold shortly before 1pm saying she was concerned about her brother and wanted him to go and stay with her to relax about his ute.

“I told her it was better for him to be in Whanganui near the pysch unit and where there are more cops in case something happened”.

Harold then drove around to Leslie’s home. He was not there, but just as he was leaving Heather arrived.

The pair talked about how their son was behaving, including his worries about his keys and his drug use.

About 20 minutes later he got a call from Heather once she was home to say Leslie was at her home when she got there.

“Heather said they had an argument because he was angry at her for calling [Rachel] and getting her involved.

“She said Leslie told her he needed the car, so she threw him the keys and he took off.”

Harold tried calling Leslie to see where he was but he did not answer.

About 1.45pm Leslie called Harold and they talked about hiring a trailer to pick up his ute.

Harold then picked Leslie up from Heather’s home and headed towards the hire centre.

“When we got there Leslie changed his mind about picking up his car.

“We had a heated discussion about picking up his car and mucking around, but he still didn’t want to go get it, so I dropped him back at his mother’s.”

Harold then went to the supermarket. While there he called Leslie’s sister and spoke about Leslie. She said Leslie had been talking about everyone being out to get him.

“[She] said she could hear in his voice that he didn’t seem well but insisted she could help.

“I told [her] we should call Police and try get him back to the hospital.”

He then called Leslie’s nurse to get and get his doctor’s number.

He claimed the nurse told him Leslie went to get this “shot” around 1pm and was “very cagey”.

“I asked [the nurse] if she drug tested Leslie, but she didn’t because she thought he might think she was picking on him and make him angry.”

The nurse said she would call Leslie’s doctor and tell him how he was behaving and express the family’s concerns.

At 4.53pm Harold received a call from Leslie asking for help. He said he was at his mother’s home and the mob was after him.

“He was puffing and was out of breath like he had been fighting or running.”

At 5.35pm Leslie phoned again and said the same thing about needing help, but he was now at his home.

Court documents reveal that between 4.50pm and 5.39pm there was an incident between Leslie and his mother at her home.

Armed with a knife, Leslie fatally stabbed his mother before leaving the address and arriving at an associate’s home about 6.20pm.

He walked into the address and sat on the doorstep asking his associate “cuz do you know where to get a gun?”

Leslie said he needed the gun because the Mongrel Mob was after him.

He then called his sister and a plan was made to go to Raetihi.

Leslie got into his associate’s car and while they were travelling he said “cuz I’ve killed mum”.

Asked why, Leslie said “Mum’s possessed, Mum’s possessed. I had to do it.”

The associate got out of the car and walked away. Leslie then drove off. The associate eventually drove to the Whanganui Police Station and told them what Leslie had said.

About 5.30pm, Leslie arrived at Rachel’s home. He made himself a chicken sandwich and about 7pm they went to bed.

Meanwhile, Leslie’s family were becoming concerned as they were unable to get hold of him or Heather.

They thought she may have gone to mass, but it was “out of character” for her not to have her phone. Harold drove to her home but there were no cars outside.

He then went and checked the laundry and shops, but could not find her.

At 8.25pm police found Heather dead in the garden beside the porch.

Harold told police that as soon as he was told about Heather’s death he became concerned for Rachel and her daughter.

“I didn’t know any details of what happened to Heather, but I immediately thought Leslie was the only one capable of doing that and given how he had been behaving it was likely.”

About 1am Rachel woke to get some water when she saw lights coming from outside.

“I woke him up and said ‘there’s all these lights and things’ and he just got up and shot out, and then suddenly there’s armed offenders squad and dogs and guns being pointed and stuff like that.”

Rachel went and spoke with the police and asked what was going on.

Leslie was told he was under arrest for murder and he replied:

“Yes, I know.”

The following day, Rachel was told what had happened.

“I was in disbelief, I was sickened and distraught.”

Heather was “the most important thing to him,” she said.

“This is where it is so hard to believe what he’s done to her because he would talk to her every day, if not multiple times a day.

Harold told police Leslie “loved his mother” and did anything for her.

“When he’s well he’s such a caring person.

“Leslie wasn’t well though and he is capable of anything when his mental state is unstable.”

Mental health system ‘failed everybody’

In April last year in the High Court at Whanganui Justice Karen Grau said there was no question Parr was responsible for his mother’s death, but that he was “legally insane” at the time he caused her death.

“I am satisfied, based on the reports of the experts, that it is clear Mr Parr suffered from a disease of the mind, a relapse in his longstanding schizophrenia, at the time he killed his mother.

“It is not the case that he did not understand the nature of his actions, but as the experts have concluded, and with which I agree, he was incapable of understanding his acts were morally wrong, and they were driven by his delusional beliefs.”

He was ordered to be detained as a special patient under the Mental Health Act.

Justice Grau said the case occurred “against a backdrop of apparent significant failures in the mental health system”.

Harold Parr wrote to Justice Grau as part of proceedings, requesting name suppression for both his son and Heather.

He said he had attended “countless appointments” and meetings relating to his son’s mental health over the years.

“I have met his doctors and psychiatrists and have a good understanding of the mental health system, what services are provided and some of its failings.”

He referenced Maulolo’s killing, saying the details of which were “too horrific to repeat”.

He wrote his son’s release by Dr Astor was “unlawful and improper” and said Leslie “should never have been let out”.

“If the proper procedures were followed Fiona would not have been killed in 1997.”

He also referenced the allegations that on the day Leslie killed for a second time he was supposed to be drug tested but wasn’t because he was “acting cagey” and the staffer didn’t want him to feel he was being “picked on”.

“This is a so-called health professional who observed unusual behaviour from a person with severe mental health issues and they didn’t do anything about it. She didn’t test him and basically allowed him to leave. A few hours later Heather was dead.”

Harold wrote the build-up to Heather’s death was “predictable”, adding his son was “on a downward spiral”.

“The health system is not aggressive enough to make decisions. They pussy foot around because they don’t want to hurt people’s feelings or upset them. But the consequence of them being indecisive is the reason that we find ourselves in this predicament now. Heather is dead and it could and should have been prevented,” he said.

“There are more questions than answers. The health system had Leslie in their custody and released him. A health professional saw Leslie on the day he killed Heather, described him as being cagey, did not do the blood test and let him go without anything. How? Who is accountable? How can someone who has previously killed another person be able to remain free when the warnings signs are right there for all to see?”

Speaking to RNZ, Rachel earlier said Leslie should not have been released from the mental health facility five days before the killing.

“I don’t know how they couldn’t have noticed how he was unwell unless he put on a really good show.”

She believed there had been a “massive failure” in the mental health system.

“It failed him, it failed everybody twice.”

Rachel often wondered whether Leslie may have killed her as well. She was in therapy and said she was “a mess”.

“I feel sad. I feel sad for the victims, I feel sad for him. I feel it’s just sad all around really. He was unwell, and he just wasn’t given the care that he should have been given.”

Reviews under way

Health New Zealand (HNZ) national director of mental health & addictions enhancement, Phil Grady, said on Monday the case was an incredibly tragic event.

“Our thoughts remain with the family, friends and communities affected. On behalf of Health New Zealand, I extend our heartfelt sympathies to everyone impacted,” Grady said.

“It is completely understandable that people feel let down and are seeking answers. We acknowledge those concerns and want to approach them with openness and respect, while recognising the deep impact this has had on both victim’s loved ones, the wider community, and the staff involved in Mr Parr’s care.”

Grady said HNZ also recognised that questions had been raised about aspects of Parr’s care and the decisions made at the time.

“These were complex clinical decisions based on the information available, and the external review has carefully examined those concerns.

“Where the review has identified areas that could be clearer or stronger, such as expectations around drug screening, information sharing, and clinical oversight, we are acting on those findings to improve consistency and strengthen practice across the service.”

Health NZ reviewed every serious adverse event that occurs within its services, and were committed to learning from them, he said.

“An external review of the care Mr Parr received leading up to this event is currently being finalised, led by senior Health NZ staff from outside the Central Region to ensure independence.

“We are committed to implementing any recommended changes so that we continue to strengthen the quality and safety of the care we provide.

“Events of this nature are incredibly tragic, but when they occur, we take them extremely seriously. The learning from this event is already informing improvements across the service, including strengthening clinical leadership, improving information sharing, clarifying clinical protocols such as drug screening, and enhancing whānau engagement and staff training.”

Mental health care in the community was complex, and risk could never be removed entirely, he said

“Especially in the case of serious mental illness, but these improvements are designed to strengthen safeguards and provide reassurance to the people we care for, their whānau, and the wider community.”

The Ministry of Health also extended its deepest sympathies to the families, friends and communities affected.

Following Parr’s second killing, Health New Zealand commissioned an external review into the care provided to the individual.

“Health New Zealand has already made changes since the incident, and I support their work,” Director of Mental Health Dr John Crawshaw said.

He said the external review was being led by an external expert panel and is near completion.

“Once the external review is available, I will carefully consider whether any further actions are required.”

Mental Health Minister Matt Doocey said in a statement his thoughts were with the families impacted.

“I have made it very clear to HNZ that patient and public safety must always be paramount, clearly situations like this are not good enough. New Zealanders deserve to have trust that when people are in the care of mental health services, the appropriate care is being taken to ensure patient and public safety is at the forefront of all decisions,” he said.

“As minister, my focus is on ensuring agencies put in place all necessary changes to prevent tragedies like this from occurring again. I have made it very clear to Health New Zealand that they must move quickly to implement the findings of the reviews and make all necessary changes to prevent this from happening again.”

Doocey was awaiting the Director of Mental Health’s decision on whether he was satisfied with the review and whether any further action needs to be taken.

Chief Victims Advisor Ruth Money said the case was “heartbreaking and preventable”.

When RNZ first revealed the case she called for a Royal Commission of Inquiry into forensic mental health facilities.

On Monday she said she stood by those calls.

“Given that unbelievably this is not the only recent case where someone in forensic mental health ‘care’ has gone on to kill twice.

“An inquiry that has mandated recommendations is the only way the system will improve, as opposed to Health NZ continuing to mark their own homework every time a tragedy such as this occurs. These victims and the community deserve infinitely better.”

Apartment block evacuated after fire in central Wellington

An apartment block in central Wellington has been evacuated after a fire on Monday evening.

Two people were in the apartment at the time of the fire.

Police say one person was seriously hurt and taken to hospital.

Fire and Emergency New Zealand (FENZ) was alerted to a small third-floor apartment fire at 5.45pm.

Five fire trucks, two aerial appliances, a command unit and a breathing apparatus tender responded.

Response crews came from Wellington, Thorndon, Brooklyn, Kilbirnie and Karori fire stations, FENZ said.

The apartment block was evacuated and the fire quickly extinguished.

Fire investigators were on the scene, as well as police and ambulance.

Government’s failure to provide any relief for fuel crisis

Finance Minister Nicola Willis today announced no new support for families hit by the fuel crisis.

“Nicola Willis pulled together a press conference to announce that there is no new support on the way for families, despite it costing $23 more than normal to fill an average petrol car and $36 more to fill a diesel vehicle,” says Green Party co-leader Marama Davidson.

“Governments across the world are taking steps to support their citizens while our government has no answers on providing relief to everyday New Zealanders.

“They instead ask you to tighten your belts even more.

“People are facing huge price increases, and the Finance Minister has said ‘I have not taken recommendations to Cabinet and I have not considered specific responses.’

“Many people are already struggling with the daily cost of living. Instead of coming with a plan to alleviate hardship, the Finance Minister has nothing on the table to give the support that is needed.

“New Zealanders are looking for a plan. They want to understand what will happen and when as the fuel crisis intensifies. Willis has nothing to give them. 

“This crisis has also exposed a deeper failure in the Government’s long-term planning.

“They cancelled the Clean Car Discount, weakened the Clean Car Standard, hiked public transport fares and are locking in further exposure to volatile fossil fuel prices with their LNG terminal.”

The PSA is urging Finance Minister Nicola Willis to walk the talk and deliver support for a key group of hard working New Zealanders struggling with rising fuel costs from the Iran war – 23,000 home support workers.
The Finance Minister today said the Government was considering targeted, timely and temporary options for low income New Zealanders facing increased fuel costs triggered by the Iran war.
“There are 23,000 home support workers on low wages who look after our most vulnerable people – the elderly, disabled and injured – every single day who need help urgently, right now. They deserve better than being left to foot the bill,” said Fleur Fitzsimons, National Secretary for the Public Service Association Te Pūkenga Here Tikanga Mahi.
Workers like Pam McLaren from Blenheim are feeling the squeeze on her budget as petrol prices rise. “I’ve done the calculations, it’s going to cost me $75.66 more per week to run my vehicle. I don’t know where that money’s meant to come from. It’s ending up costing a lot to go to work, and it’s not like I can ride a bike between clients, the distance is too far.”
Fleur Fitzsimons: “If the Government is serious about relieving cost of living pressures in a targeted way, then it must follow through on today’s promise and make it a priority to compensate them for rising fuel bills. It’s the right thing to do.”
Home support workers drive their own cars between clients, caring for the elderly, disabled and injured every day, but are being reimbursed at just 63.5 cents per kilometre, well below the IRD rate, and less than half of the travel costs they face.
“These workers were already being undercompensated before the fuel crisis. They are also disadvantaged by the Government’s scrapping of a pay equity pay rise last year. They cannot afford to subsidise the cost of delivering essential government-funded services.”
Travel costs for home support workers are governed by the In Between Travel Settlement Act, introduced under a National-led Government in 2015. There have been only two increases to the mileage rate in a decade, the last one was four years ago.
“It’s well past time for an urgent review,” said Fleur Fitzsimons.
“Funding for home support already flows through MSD and the Ministry of Health. An increase to the mileage rate can be delivered quickly and efficiently through existing channels. There is no excuse for delay.”
The PSA will be raising this issue urgently with the Government.

Stolen car recovered, man to face charges

A stolen vehicle spotted travelling at speed through Papakura last night caught the eye of Police.

At about 11.45pm, officers noticed a Subaru travelling an excessive speed on Beach Road towards Chichester Drive.

Counties Manukau South Area Prevention Manager, Inspector Matt Hoyes, says a Police Camera Operator became aware of the job and observed the vehicle as it continued on State Highway 1 near Ramarama.

“The vehicle has then exited at Razorback Road where the Police helicopter has been able to monitor its movements to Tuakau Bridge where it parked outside a rural address.

“Officers quickly took four people at the address into custody and the vehicle was recovered.”

Inspector Hoyes says this was great work by officers who persevered when losing sight of the stolen vehicle.

“We would also like to remind people to remain vigilant and make sure their vehicles and property are kept safe and secure.

“Any suspicious or concerning activity should be reported to Police immediately on 111.”

An 18-year-old has been charged with burglary and unlawfully taking a motor vehicle and will appear in Pukekohe District Court at a later date.

‘No need to panic’, fuel supplier says as average petrol price surges past $3

Drivers are being urged not to panic-buy fuel as motorists worry about rising prices.

Meanwhile, Finance Minister Nicola Willis stands by her government’s decision to stop the electric car rebate scheme, as she looks at how the government could respond to rising prices.

Petrol stations across the country are seeing a surge of drivers filling up as petrol prices rise.

Petrol price monitoring app Gaspy says the average price of 91 petrol is now above $3 and has risen 20 percent since the start of the month.

Spokesperson Mike Newton said the average national price at the start of March was about $2.50 per litre.

He said it had been rising quickly.

The rise in prices was largely due to the conflict in the Middle East.

US President Donald Trump is calling for countries to send ships to secure the Strait of Hormuz, which is effectively closed as Iran launches attacks to halt maritime traffic.

The area is critical because around 20 percent of the world’s oil consumption or 20 million barrels a day, usually passes through it.

It’s resulted in several petrol stations running dry over the weekend.

Newton said most of the petrol stations running low on gas seemed to be Gull.

“It’s not a supply problem, they have plenty of fuel in the tanks. It’s just they have to get it into the tankers and get it to the stations. Hopefully we’ll start to see that be alleviated in the next couple of days.”

He said the average price was now just 6c away from the level it reached when the Government cut the fuel excise tax, after the Russian invasion of Ukraine.

“We’re starting to get into that territory and this government has said they’re less interested in doing that… so it’ll be interesting to see when the pressure starts to build.”

Finance Minister Nicola Willis told Morning Report the government was carefully monitoring fuel stock levels.

New Zealand has around 32 days’ worth of fuel in the country and 25 days in ships on the way to the country.

“There is no current issue with the availability of fuel,” Willis said. “Were that to be the case, we would get very good forewarning because we would be aware of fuel companies reporting to us that orders had been disrupted or cancelled. They have not made any reports of that sort to us at this stage.

If we got that warning, Willis said we would have several weeks to plan for it.

“This is why we have these minimum stock holdings in the country, so we don’t get ourselves into a panic situation.”

She said the government hasn’t needed to review its sanctions on Russian-origin oil.

“This is, obviously, an event that is unfolding; if there are changes in that position, we will review them when they occur.”

Waitomo CEO Simon Parham said demand at the company’s petrol station has increased by about 15 percent.

“We’ve had the odd run out from here and there, but it’s really been for a maximum of 30 minutes,” he told Morning Report.

“What we are seeing is that increase in demand, coupled with a very stressed driver system, anything from a delay at the terminal to a truck breaking down, it’s just caused that slight delay in he system, so you have a slight run out.

“There’s nothing to worry about.”

He expects to see the demand soften.

“We’re still in good shape… There’s no need to panic. Yes, we are suffering from high prices, which is tough on everyone, but there is no need to panic at the moment.”

He said if the cargo orders can’t be placed, that’s when New Zealand may need to look at managing stock.

“If we are staying around that 50-day mark, that’s a rolling 50 days, then we’re fine. If we start to see that drop back, then that’s when we have to manage stock,” Parham said.

Westpac chief economist Kelly Eckhold said next month will be very difficult if things don’t improve.

“The refiners in Asia are going to run out of feed stocks to be able to continue to produce at the levels we are used to,” he said.

“I think if we are sitting here in mid-April and things haven’t improved, I think we will be looking at the possibility that everybody is just going to have to rein things in a bit.”

Brent crude has been sitting around US$100 a barrel, but if it reaches US$150 a barrel, Eckhold said that’s when the real damaging impacts on businesses and consumers would be seen.

Finance Minister considering govt response to rising prices

Willis has shut down suggestions of temporarily cutting the fuel excise tax, as the Labour government previously did in response to the Russia-Ukraine war, saying it was too broad.

She said she was closely looking at the cost of living impacts the rise in fuel prices has on lower-income working New Zealanders.

“When the petrol prices go up this much, that has an effect on the cost of living, particularly for working New Zealanders who use their cars to get to work. We are very conscious of that and are considering whether a government response is warranted,” Willis said.

Willis stands by her government’s decision to remove the electric vehicle rebate.

She said the rebate was very untargetted.

“I simply don’t accept the idea that giving subsudies to millionaires in Remuera would help those afflicted by high petrol prices,” Willis said.

She said if the government were to give support, it would be targeted, temporary and timely.

Willis said she has not taken advice to Cabinet yet on these matters.

The owner of a bus company said more people could opt for public transport over private vehicles.

Kiwi Coaches owner Dayton Howie told Morning Report petrol price rises were cutting into margins.

He said the costs were currently being absorbed, but it was unclear how long that could last.

Howie said students could miss out on school trips if fuel prices keep going up.

Government’s climate change plans go to the High Court

A landmark legal case that argues the government’s plan to tackle climate change is unlawful and risky will go ahead today.

Climate advocates will argue that the government broke the law when it dismantled dozens of climate policies soon after the 2023 election, before it had consulted the public.

They also say the current plan relies too heavily on planting trees to offset greenhouse gas emissions, instead of reducing the amount of emissions the country produces in the first place.

Lawyers for Climate Action and the Environmental Law Initiative (ELI) are jointly taking the case against Climate Change Minister Simon Watts.

The organisations are asking the High Court to declare the minister’s decisions unlawful and to throw out the current emissions plan so a new, more ambitious one can be prepared.

An environmental law expert says the case is “hugely significant” and has similarities to challenges in the UK, which resulted in changes to that government’s climate plans.

Under New Zealand’s climate laws, the government must produce five-yearly emissions reductions plans, which set out how the country will meet its domestic climate targets.

At the moment, those targets are to reduce carbon dioxide and other long-lived gas emissions to net zero by 2050, and to reduce methane emissions to 14 to 24 percent below 2017 levels by the same deadline.

The methane target was originally a 24 to 47 percent reduction by 2050, but the government changed this last year in response to lobbying from the agricultural sector, which produces half of New Zealand’s methane emissions.

There are also interim targets for 2030: to halve long-lived gases from their 2005 levels, and a 10 percent reduction of methane emissions from 2017 levels.

Subsidies for electric vehicles, and a fund to help businesses electrify their coal- and gas-fired industrial processes, were among policies that the government chose to scrap in late 2023.

ELI senior legal researcher Eliza Prestidge-Oldfield said climate laws allowed the government to make changes to an emissions reduction plan, but they must consult on any changes that are more than minor or technical.

Instead, the government scrapped large parts of the plan before formally amending it.

“By the time the plan was actually amended, there were over 30 initiatives that were being consulted on where the decisions had already been made,” she said.

“What the government should have done is consulted on any amendments before it locked in those changes.”

‘Phenomenal’ reliance on pine planting

The latest emissions reduction plan, which kicked in at the start of this year, was not really an emissions reduction plan at all, Prestidge-Oldfield said.

“Instead of having arranged policies that might substantively reduce our reliance on fossil fuels, or replace sectors of the economy that currently are reliant on out that equipment with new equipment, they’ve just relied on baseline modeling and trees offsetting carbon emissions.”

The reliance on forestry planting in the plan was “quite phenomenal”.

“The reliance on forestry means that people aren’t going to be doing the other things that they can do, that are technically feasible now and may even have a good payoff, unless they’re cheaper than a forestry credit,” she said.

Relying on mostly pine plantations was “inherently risky”, she said.

“As the climate heats, the risk of them burning down is pretty significant. We’ve already seen issues with extreme weather events, windfall, forestry slash – so these are not a robust solution in and of themselves.”

Lawyers for Climate Action executive director Jessica Palairet said using trees and other types of carbon sequestration was an important part of the climate response, because it would help to remove carbon dioxide already warming the planet.

It could not simply replace reducing emissions at their source, though.

“The government shouldn’t treat reductions and removals as equivalent,” Palairet said.

“They’re different, they needed to be treated differently under the law, and we don’t think the minister even turned his mind to whether this plan of planting our way out of the climate crisis complied with international law.”

The global Paris Agreement did not explicitly state that governments must prioritise reducing emissions over removing them from the atmosphere, Palairet said.

“But there’s numerous parts … that do suggest a preferencing of reductions over forestry removals.”

States were also expected to take a precautionary approach to reducing their emissions, she said.

“So reduce emissions now, rather than keep them at high levels and leave them for future generations to deal with.”

Case is significant – environmental law expert

The hearing in Wellington will add to a growing body of climate law cases being levelled at governments around the world.

An advisory opinion issued by the International Court of Justice last year found that developed countries like New Zealand were expected to lead the way in making emissions reductions, and that the way was open for countries to sue each other for failing to take action.

Auckland University associate professor Vernon Rive said the latest case was “hugely significant”.

“It concerns some quite fundamental planks of the government’s policy and approach on climate mitigation,” he said.

“It tests whether from a legal perspective the policy reliance on the [emissions trading scheme] – almost to the exclusion of everything else – is a legitimate approach.”

The outcome could set a precedent for how emissions reduction plans were set, especially about the level of certainty the government needed to have that a plan could meet an emissions budget.

“I don’t think anyone expects there to be 100 percent certainty, because this involves modelling and predictions of what will happen in the future,” Rive said, “But there is an expectation of a level of certainty and robustness and credibility.”

That included what wiggle-room there was if some policies did not succeed, or something else unexpected happened.

“The government’s plan – by its own recognition – is cutting it very, very fine,” he said. “There’s a very small buffer for achieving it or not achieving it.”

New Zealand’s system of setting greenhouse gas budgets and emissions reduction plans was similar to Ireland and the UK, where governments had also faced legal challenges.

“[There have been] two significant cases in the UK where environmental interests have successfully challenged the UK government’s emissions reduction plans, or their equivalent,” Rive said.

“The court has said look, there are just too many uncertainties here involved in your plan – you need to go back and do it again, and do it properly this time.”

New Zealand’s legal system was similar to the UK’s, so he expected the courts here to take a similar approach to the law.

“Each of these cases will turn on their own facts … but this is a very credible claim.”

The hearing is expected to last three days, with a reserved decision later this year.

Rotorua, Hastings crashes cause highway closure and serious injuries

A crash in Hastings left one dead and closed a road and another in Rotorua closed State Highway 5.

Police said one person was found dead at the scene of a single vehicle crash in Hastings near Te Mata Road.

Waimarama Road is currently closed and diversions are in place while the scene is examined. Motorists have been advised to avoid the area.

Police got the call around 6:45am on Sunday morning and say they are looking into the circumstances of the crash.

In the Bay of Plenty the crash near Ngongotahā has closed State Highway 5.

It occurred on the stretch between Western Road and State Highway 36.
